Terms of Service
These terms are a contract between you and dishi. They are written to give us the control we need to run a fair, honest service, and to promise you that we will use that control in good faith.
1. Acceptance
By creating an account or using the dishi service at dishi.me and any related apps, pages and APIs (the “Service”), you agree to these Terms and to our Privacy Policy, which forms part of them. If you do not agree, do not use the Service.
2. Who may use dishi
You must be at least 13 years old. If you are under 18, you confirm that a parent or guardian has agreed to these Terms on your behalf. You may hold one personal account. If you use the Service on behalf of a restaurant or business, you confirm you are authorised to bind it.
3. Your account
Sign-in is by a one-time code sent to your email, or through a supported provider such as Google. You are responsible for keeping your email and provider accounts secure and for everything done through your dishi account. Tell us promptly at hello@dishi.me if you believe it has been compromised.
4. What dishi is, and is not
- dishi helps you record what you eat, learn your own taste, and decide what to order. Ratings and comparisons are the opinions of the people who made them. Recommendations and predictions are estimates and can be wrong.
- Dish names, ingredients, prices and diet flags are recognised by automated systems from photos and menus and may be inaccurate or incomplete. Always confirm allergens and dietary requirements with the restaurant. dishi is not medical, nutritional or dietary advice.
- Restaurant information may be out of date. dishi is not party to any transaction between you and a restaurant.
5. Your content
You keep what is yours. Photos, ratings, notes, posts, menu information and anything else you add (“Content”) remain yours.
The licence you give us. So that we can run and build the Service, you grant dishi a worldwide, non-exclusive, royalty-free, transferable licence, with the right to sublicense to our service providers, to host, store, reproduce, process, adapt, translate, display, distribute and create derivative works from your Content for the purposes of operating, improving, promoting and developing the Service and new products and services. This includes deriving your taste profile, recognising dishes, and producing aggregated and de-identified data and statistics, which we may use for any purpose, including commercial purposes, without limitation — subject always to the commitments in our Privacy Policy, which mean such data will not identify you and your personal data will not be sold.
Public content. Content you choose to publish may be viewed, shared and reproduced by anyone, including on dishi’s own public pages and in previews on other platforms. The licence above continues for published Content that has already been shared, and for aggregated or de-identified data derived before removal, after you delete it.
Your promises. You confirm that you have the rights needed to grant this licence; that your Content does not infringe anyone’s rights or break any law; that your ratings reflect your genuine experience; and that any people identifiable in your photos have agreed to appear.
Removal. We may remove or hide Content that we reasonably believe breaks these Terms, the law, or the trust of other users, and where practicable we will tell you why.
6. Acceptable use
You agree not to:
- post ratings or comparisons you did not genuinely make, rate dishes you did not eat, or coordinate with others to manipulate ratings, rankings or a restaurant’s standing;
- offer or accept payment or benefit for ratings, posts or placement;
- impersonate any person or business, or claim a restaurant page you are not authorised to claim;
- upload content that is unlawful, infringing, defamatory, hateful, harassing, sexually explicit, or that reveals another person’s personal data without their consent;
- scrape, crawl, harvest or bulk-download any part of the Service or its data, or access it by automated means except through interfaces we make available for that purpose;
- reverse engineer, probe, disrupt, overload or interfere with the Service or its security, or circumvent any limit we set;
- use the Service to build a competing dataset or model from other users’ Content;
- use the Service for anything unlawful.
7. Restaurant owners
A business may claim its page to publish accurate menus and details. Claiming a page does not buy, and cannot buy, placement, ranking or influence over what dishi recommends to anyone. Owners must keep published information accurate, may not remove or alter genuine user ratings, and grant dishi the same Content licence as in section 5 for what they publish. We may revoke a claim if we believe it was made without authority or in breach of these Terms.
8. Taste export and third-party AI
The Service can generate a text export of your taste profile for you to use with AI assistants of your choice. What you do with it, and what those providers do with it, is between you and them. dishi is not responsible for the outputs of any third-party AI, and the export is provided without warranty as to accuracy.
9. Our rights over the Service
To keep dishi working, fair and lawful, we reserve the right, acting reasonably and in good faith, to:
- change, suspend, limit or discontinue any part of the Service, or the Service as a whole, at any time;
- set and change limits on usage, storage, uploads and features;
- freeze, suspend, restrict or terminate your account, and remove your Content, if we reasonably believe you have breached these Terms, manipulated ratings, harmed other users or the integrity of the Service, exposed us to legal risk, or if the law requires it;
- close accounts that have been inactive for an extended period, after attempting to notify you;
- investigate suspected breaches and cooperate with law enforcement and regulators.
In good faith means: where it is practicable and lawful, we will tell you what we have done and why, give you a chance to respond, and restore access if we got it wrong. We will not use these rights to avoid an obligation we owe you, and we will not exercise them because of the content of an honest, negative rating.
10. Ending your account
You may stop using dishi and ask us to delete your account at any time by contacting hello@dishi.me. Deletion follows the Privacy Policy. Sections 5 (for the parts stated to survive), 9 and 12 to 17 survive termination by either side.
11. Intellectual property
The Service, its software, design, text, graphics, the dishi name and marks, and the taste creatures and characters are owned by dishi or its licensors and protected by intellectual property law. We grant you a personal, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted. Feedback and suggestions you give us may be used freely without obligation to you.
12. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, dishi disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not warrant that any recommendation, prediction, recognised dish, price, ingredient or diet flag is correct.
13. Limitation of liability
To the fullest extent permitted by law, dishi and its officers, contractors and providers will not be liable for any indirect, incidental, special, consequential or punitive loss, or any loss of profit, data, goodwill or opportunity, arising from or in connection with the Service or these Terms, however caused. Our total liability for all claims in any twelve-month period will not exceed the greater of HK$100 and the amount you paid us for the Service in that period. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
14. Indemnity
You will indemnify dishi against claims, losses and reasonable costs (including legal fees) arising from your Content, your use of the Service, or your breach of these Terms or the law.
15. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Before starting any formal proceedings, you agree to contact us and give us 30 days to resolve the matter. Subject to that, the courts of Hong Kong have exclusive jurisdiction, without prejudice to any mandatory consumer rights you have under the law of the place where you live.
16. Changes to these Terms
We may update these Terms as the Service develops. Minor changes take effect when posted. For material changes we will give notice in the Service or by email before they take effect. If you keep using dishi after that date, the new Terms apply; if you do not agree, stop using the Service and ask us to delete your account.
17. General
These Terms and the Privacy Policy are the entire agreement between you and dishi about the Service. If any part is found unenforceable, the rest remains in effect. Our not enforcing a right is not a waiver of it. You may not assign these Terms; we may assign them as part of a reorganisation, merger or sale, on notice to you. Nothing here creates a partnership, employment or agency relationship.
